2. Acceptance of Terms

By accessing our website or placing an order, you agree to be bound by these Terms and Conditions, our Privacy Policy, and our Shipping and Returns Policies.

We reserve the right to update these Terms at any time without prior notice. The Terms in force at the time of your purchase will apply to that transaction.

 

3. Products and Availability

3.1 Product Descriptions

We make every effort to ensure product descriptions, images, and specifications are accurate and up to date. However, we do not warrant that content is error-free, complete, or current.

3.2 Stock Availability

All products are subject to availability. If a product is out of stock, we will notify you and offer a full refund, backorder option, or alternative product.

3.3 Pre-Orders and Coming Soon Products

By placing a pre-order, you authorise us to charge your payment method at the time of order. Pre-orders will be dispatched as soon as stock becomes available. If a pre-ordered product is cancelled or significantly delayed, you will be offered a full refund.

3.4 Age Recommendations

Products are sold with recommended age ranges based on developmental and safety guidelines. These are guidelines only. Adult supervision is recommended at all times when products are used by young children. Please refer to individual product packaging and listings for specific age warnings and safety information.

 

4. Pricing, GST and Currency

All prices are in Australian Dollars (AUD) and include GST at 10%, unless otherwise stated. International orders are not subject to Australian GST.

We reserve the right to change prices at any time without prior notice.

Where multi-currency display is available, prices shown in other currencies are indicative only. Your payment will always be processed in AUD.

A tax invoice is automatically emailed to you upon completion of your purchase. If you require a separate or amended tax invoice, please contact admin@daynasplace.com.

 

5. Payment

5.1 Accepted Payment Methods

We accept the following payment methods:

  • Credit and debit cards (Visa, Mastercard, American Express) via Wix Payments or Stripe

  • PayPal and PayPal Pay in 4

  • Afterpay (where available)

  • Purchase Orders from schools and NDIS plan managers (subject to prior approval — contact admin@daynasplace.com before placing your order)

5.2 Payment Security

Dayna's Place Pty Ltd does not store your full credit card details. Payment processing is handled by third-party providers (Wix Payments, Stripe, PayPal, and Afterpay) and is subject to their respective terms and privacy policies.

5.3 Buy Now Pay Later

Afterpay and PayPal Pay in 4 are third-party services. We are not responsible for any fees or charges arising from your use of these services.

5.4 Failed Payments

If your payment is declined, your order will not be processed. We reserve the right to cancel any order where payment has not been received in full.

5.5 Purchase Orders (Schools and NDIS)

All purchase order requests must be submitted to admin@daynasplace.com prior to ordering. Orders will not be dispatched until payment or a valid approved purchase order has been received. Payment terms are strictly 7 days from date of invoice.

 

6. NDIS Purchases

Speech pathology products and resources may be eligible for funding under certain NDIS support categories, including Capacity Building — Improved Daily Living.

It is the responsibility of the NDIS participant, their plan manager, or support coordinator to confirm that a purchase is appropriate and fundable under their plan. We do not provide NDIS plan management advice.

7. Shipping and Delivery

7.1 Dispatch Timeframe

Orders are typically dispatched within 1–3 business days of payment being received and confirmed. During peak periods or sale events, dispatch times may be longer. You will receive a shipping confirmation email with tracking details once your order has been dispatched.

7.2 Shipping Rates

Shipping costs are calculated at checkout based on the delivery address, package weight, and selected shipping method. Shipping rates are displayed clearly before you complete your purchase. We offer standard and express shipping options where available.

7.3 Domestic Delivery (Australia)

Domestic orders are shipped via Australia Post or a comparable carrier. Standard delivery timeframes are 2–7 business days depending on your location. Express delivery is typically 1–3 business days. These timeframes are estimates provided by the carrier and are not guaranteed.

7.4 International Delivery

We ship to selected international destinations including New Zealand, United States, Canada, United Kingdom, and Europe. International shipping rates and timeframes are displayed at checkout. International customers are responsible for any customs duties, import taxes, or fees imposed by their country's customs authority. These charges are not included in the product price or shipping cost and are payable by the recipient.

7.5 Delivery Address

It is your responsibility to provide a complete and accurate delivery address at checkout. Dayna's Place Pty Ltd is not responsible for orders delayed or lost due to an incorrect or incomplete address provided by the customer. If a package is returned to us due to an incorrect address, we will contact you to arrange redelivery at your cost.

7.6 Lost or Damaged in Transit

If your order is lost or damaged in transit, please contact us at admin@daynasplace.com within 14 days of the expected delivery date. We will work with you and the carrier to resolve the issue. Where a product is confirmed lost or arrives damaged, we will offer a replacement or full refund at our discretion.

7.7 Service Interruptions

Dispatch and delivery timeframes may be affected by factors outside our control, including but not limited to public holidays, extreme weather events, carrier delays or strikes, and customs processing. We will make reasonable efforts to notify customers of any significant delays but are not liable for delays caused by such events.

 

8. Returns, Refunds and Exchanges

Australian Consumer Law

Nothing in these Terms limits your rights under the Australian Consumer Law (ACL). Our goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

8.1 Faulty or Damaged Products

If you receive a product that is faulty, damaged, or not as described, please contact us at admin@daynasplace.com within 14 days of receipt with your order number and photos of the issue. We will arrange a replacement, repair, or full refund including return shipping costs, in accordance with the Australian Consumer Law.

8.2 Change of Mind Returns

We accept change of mind returns within 14 days of delivery, subject to the following conditions:

  • The product must be unused, unopened, and in its original packaging

  • Proof of purchase must be provided

  • Return shipping costs are the responsibility of the customer

  • A refund will be issued to your original payment method within 5–10 business days of us receiving the returned item

  • Shipping costs are non-refundable for change of mind returns

8.3 How to Return

To initiate a return, email admin@daynasplace.com with your order number, reason for return, and whether you would prefer a refund or exchange. Do not return items without prior authorisation. Unauthorised returns may not be accepted.

8.4 Non-Returnable Items

The following items cannot be returned or exchanged unless faulty:

  • Products that have been opened, used, or are not in original condition

  • Downloadable digital products once accessed

  • Products purchased on final sale

 

9. Intellectual Property

All content on daynasplace.com, including but not limited to text, images, product names, game designs, logos, graphics, and branding, is the intellectual property of Dayna's Place Pty Ltd or its licensors and is protected by Australian and international copyright, trademark, and other intellectual property laws.

Octoword Adventures®, Dayna's Fishing Adventures, and Solve It! Say It!® are registered or pending trademarks of Dayna's Place Pty Ltd. Unauthorised use, reproduction, or distribution of any content or product design is strictly prohibited.

 

10. Privacy

Dayna's Place Pty Ltd is committed to protecting your personal information. We collect personal information necessary to process your order, communicate with you, and improve our services. We do not sell, rent, or share your personal information with third parties for marketing purposes.

Your information may be shared with third-party service providers who assist us in operating our website and processing orders (including Wix, Stripe, PayPal, Afterpay, and Australia Post), solely for the purpose of fulfilling your order.

11. Limitation of Liability

To the maximum extent permitted by law, Dayna's Place Pty Ltd, its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products or website.

Our total liability to you for any claim arising from a purchase on daynasplace.com will not exceed the amount you paid for the relevant product.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.

 

12. Product Safety and Warnings

Our products are designed and tested with safety in mind. The following warnings apply:

  • Some products contain small parts and are not suitable for children under 3 years of age — choking hazard. Warnings are on products where appropriate.

  • Adult supervision is recommended when products are used by young children.

  • Products are educational resources and do not replace professional speech pathology assessment or treatment.

  • If you have concerns about a child's speech or language development, please consult a qualified speech pathologist.

 

13. Professional Services Disclaimer

The products sold on daynasplace.com are educational resources designed to support speech and language development. They are not a substitute for professional speech pathology assessment, diagnosis, or treatment. Nothing on this website constitutes professional speech pathology advice.

If you have concerns about your own or your child's speech, language, or communication development, please seek assessment from a qualified Speech Pathologist or Speech-Language Pathologist.

 

14. Governing Law

These Terms and Conditions are governed by the laws of Queensland, Australia. Any disputes arising from these Terms or your use of daynasplace.com will be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
